Court of Protection and Deputyship

When someone receives a large award of damages and their mental capacity is such that they cannot deal with their own financial affairs, it is necessary to apply to the Court of Protection to appoint a person known as a Deputy (formerly a Receiver) to assist with the management of the funds.  We provide the service of making the Application to appoint a Deputy and we also act as Deputies on behalf of the Protected Person.  

With failing health as a result of medical conditions such as dementia or Alzheimer ’s disease, it is sometimes advisable to consider the appointment of a Power of Attorney to take decisions on your behalf.  These decisions can be in respect of financial affairs, property, health and accommodation.  We are happy to prepare Lasting Powers of Attorney on behalf of people with these difficulties.

As part of your damages schedules you will be including the cost of appointing a Deputy and projected costings for the services of the Deputy following settlement of the case.  John Bruty is an experienced Clinical Negligence practitioner having dealt with many cases where Professional Deputies (formerly Receivers) have been appointed by the Court of Protection.
